Supreme Court’s Judgement in 2008 Mandated a Candidate to Score At Least 25% in the FCT – Aondoakaa

Former Minister of Justice, Michael Aondoakaa, says the Supreme Court’s Judgement in 2008 necessitates that a candidate scores at least 25% of the votes in the FCT, the word ‘and’ was interpreted as conjunctive. That notwithstanding, the Supreme Court has the right to depart from its previous decisions if the justice of the case demands that.

  • While I don't have issue with who is declared winner, am of the opinion that constitution is supreme.
    The 1999 constitution, as amended, describes what a State of Federation is, and FCT is neither included in the list nor fits the description therein.
    If any SC judgement has deemed FCT a State, kindly let the proponents of that theory refer us the learning ones, so we can take heed.

      • thats on a different circumstance , as regards this 25% it not seen nor should be treated like a state, or are you telling me that they can just chose when FCT should be treated like a state?

        • That same constitution states that the president shall pick his ministers in all 36 states of the federation, if i may ask why is Abuja not part of the states with ministerial appointment??

          • The Federal Capital Territory Administration (FCTA), headed by a presidentially appointed minister, administers the FCT. The Federal Capital Development Authority (FCDA) manages the building and infrastructural development of the urban area. The current FCT minister is Malam Muhammad Bello.

  • You people should stop this nonsensical thing you are pushing. Saying a candidate must score 25% in the FCT is mandatory to win a presidential election is tantamount to treating Nigerians in the FCT as special and more important than other Nigerians living in other parts of the country. Such law if exist is against the constitution which sees all Nigerians as equal.

    • Well, it doesn't directly or indirectly mean what you just highlighted ,see it this way , since every states cannot have the seat of power, that makes FCT special and very imperative to get the 25% my 2 cents
