A South Carolina mother is suing toy giant Mattel after a mistake on the packaging of a doll led her daughter to a pornographic website.
Holly Ricketson filed a civil lawsuit on Tuesday, claiming she purchased the doll for her minor daughter, only for the packaging to contain a link to an adult website.
According to the lawsuit, when her daughter accessed the website, it featured “hardcore, full-on nude pornographic images,” causing both of them emotional distress.
Mattel had released the singing dolls last month in anticipation of the film Wicked, starring Cynthia Erivo and Ariana Grande. The company apologised for the error and recalled the dolls.
However, Ricketson’s lawsuit argues that the error rendered the dolls “unfit for their intended purpose” and claims Mattel has failed to offer refunds. She said she would not have purchased the doll had she known about the mistake.
The class action lawsuit seeks $5 million in damages for anyone in the United States who bought the dolls with the incorrect packaging. It accuses Mattel of negligence, selling unfit products, and violating California consumer protection laws.
The Wicked film adaptation, which premiered on 22 November, has grossed over $263 million in the US and $360 million globally since its release. Mattel has yet to respond to the lawsuit.
