The three-member panel, chaired over by Justice C.E. Nwosu-Iheme, issued a judgement on Monday ordering the Independent National Electoral Commission to issue a Certificate of Return to Yohanna as the validly elected representative representing the region in the National Assembly.
The appeal court overturned the tribunal’s decision, which had previously declared Abbo of the All Progressives Congress the winner of the senate race.
INEC had certified Abbo the winner of the parliamentary election on February 25, 2023.
After hearing arguments from parties, the Appeal Court agreed with Usman that, according to Section 137 of the Electoral Act, 2022, the results presented plainly demonstrated that there was no conformity with the Electoral Act.
Following that, the court discounted the illegitimate votes from both parties and determined that Yohanna and the PDP had won the election by a majority of lawful votes.
Senator Abbo denounced the decision as a coup against democracy, but urged his followers to remain calm.
