NCC Takes ‘Pre-Enforcement Action’ Against Starlink Over Unauthorised Subscription Price Hike

The Nigerian Communications Commission has initiated pre-enforcement action against Starlink for increasing subscription prices without regulatory approval.

The Nigerian Communications Commission (NCC) has initiated pre-enforcement action against Starlink, after the satellite internet provider raised its subscription prices without the required regulatory approval, in violation of the Nigerian Communications Act and the company’s licensing conditions.

In a statement, the NCC said Starlink’s action violates Sections 108 and 111 of the Nigerian Communications Act (NCA) 2003, as well as the company’s licence conditions related to tariffs.

The regulator emphasised that Starlink announced the price increase despite having submitted a request for approval, for which the Commission had not yet communicated a decision. Consequently, pre-enforcement proceedings began on October 3, 2024.

In a previous statement, the Commission criticised the company for “jumping the gun” after requesting a price adjustment but proceeding with the increase before the Commission gave approval. Although, the NCC suggested Starlink’s actions were a violation of the NCA and warned of possible enforcement measures.

However, shortly after issuing this statement, the NCC withdrew it, citing that it had been “issued in error.”

Despite the temporary withdrawal of the initial statement, the NCC has now clarified its stance, asserting that Starlink’s price hike was implemented in contravention of regulatory requirements.

The Commission reiterated its commitment to ensuring regulatory stability in the telecommunications sector and warned that any licensee acting outside the bounds of the law would face enforcement actions.

Starlink has yet to publicly comment on the NCC’s latest actions or provide further clarification on the price increase. The situation remains unresolved as the Commission’s pre-enforcement actions proceed.
