Court Bars Aminu Ado Bayero, Others From Parading As Emirs

Kano High Court has ordered deposed Emirs to return all properties of the Kano State Emirate Council to the government.

A Kano High Court presided over by Justice Amina Aliyu, has perpectually restrained the 15th Emir of Kano, Aminu Ado Bayero and four others from parading themselves as Emirs. 

In her judgement Monday, Justice Amina, held that Bayero and the four others, whosoever by themselves, servants, privies and any other persons appointed by them should stop parading themselves as Emirs of Kano, Bichi, Gaya, Rano and Karaye. 

She held that “the Kano State House of Assembly has the power to amend and proposed a bill for the peace and good governance of a state pursuant to section 4 rule 6,7(b) of 1999 Constitution as amended.

“The Kano State Governor has the right to ascent the the proposed bill to law after being passed by the state assembly” 

The court also, ordered the deposed Emirs to surrender all movable and inmovable properties in their possession that belongs to the Kano State Emirate Coucil to the state government. 

On the withdrawal of the legal councel to the first respondent without notice to other parties, Justice Amina held that it was done unprofessionaly and without moving their motion is as good as not filing it since it has been abandoned.

The judge said the act of the 6th to 9 respondent for smuggling the first respondent to Kano after the enactment of the Emirate Repeal Law 2024 has disregarded what they have sworn-in as regards to the protection of lives and property.

Earlier, Counsel to the applicant, Ibrahim Isa-Wangida, urged the court to discountenance the respondent affidavit of facts pursuant to order 39 rule 1 and 2 of the Court.

However, Counsel to Ado-Bayero, Abdul Muhammed SAN, informed the court that they have an affidavit of fact dated July 3, 2024 attached with a notice of appeal and a motion of stay of proceedings.

He urged the court to stay of proceedings pending the hearing and determination of the motion at the appeal court. 

Kano State Government, had filed a case asking the State High to stop the 15th Emir and four other to desisst from parading themselves as Emirs. 

The Government also gave the Deposed Emir’s 48 Hours within which to vacate their respective Palaces after their desposition. . 

Governor Abba Yusuf had signed into law the Kano Emirate Council Bill (2024), after repealing the Kano Emirate Law (2019) which created four additional emirates of Bichi, Gaya, Karaye and Rano, bringing to five the Emirates across the state.
