Atiku Accuses Supreme Court of Legalising Forgery, Illegality, Identity Theft

The Presidential candidate of the Peoples’ Democratic Party in Nigeria’s 2023 election, Atiku Abubakar, has accused the supreme court of legalising forgery, illegality, identity yheft, and perjury.

The former Vice President said this at a press briefing on Monday in Abuja.

He insisted that Bola Tinubu, was not qualified to contest the February 2023 presidential poll.

“Someone asked me, what would I do if I lost my election petition appeal at the Supreme Court. In response, I said that as long as Nigeria wins, the struggle would have been worthwhile.

“By that, I meant that the bigger loss will not be mine but Nigeria’s if the Supreme Court legitimises illegality, including forgery, identity theft, and perjury as it has done. 

“If the Supreme Court, the highest court of the land, implies that crime is good and should be rewarded, then Nigeria is lost. I am sure that history will vindicate me.”

Atiku said when people lose confidence in the electoral process, democracy is on life support.

The PDP’s candidate also said he will not leave the political arena despite the Supreme Court verdict.

“As for me and my party, this phase of work is done. However, I am not going to go away, if you think I am going to go away, forget about it,

“For as long as I breathe, I will continue to struggle with other Nigerians to deepen our democracy. I will continue to work for the return of political and economical restructuring that the country needs,” he added.

On Thursday, the Justice John Okoro-led panel of the apex court threw out all the appeals by Atiku and Obi for lacking merit. The panel thereafter upheld electoral victory of Tinubu.

  • Atiku stop blaming the supreme court of Nigeria for failure to give you a fair judgement in the alleged Chicago State University certificate forgery. Your lawyer is the person who failed to protect your right by failing to properly object to the court's suggestions that Chicago State University officials' wrote two contradictory letters, one acknowledging the Bola Tinubu graduated from Chicago State University, the other letter saying that Bola Tinubu did not graduate on the ground that the letters were not sworn under the penalty of perjury therefore cannot be admitted from the bar.

    Unauthenticated letters, letters that are not sworn to under penalty of perjury are not relevant and admissible under the rules of evidence. The only kinds documents that are admissible at bar are documents that are sworn to under penalty of perjury, such as, the deposition from Chicago University officials, the official transcript from Chicago State University. The supreme court of Nigeria will be violating evidentiary foundation, due process of law if it were to rely on unsworn letter instead sworn deposition and official academic transcript in determining the case concerning alleged forged certificate President Bola Tinubu submitted to the INEC for the purpose of 2023 Nigeria presidential election.

    Certified true copy of a public document can be tendered from the Bar without formally tendering it through a witness vide Agagu v. Dawodu (1990) 7 NWLR (pt. 160) 56, Anatogu v. Iweka II (1995) 9 S.C.N.J.31 Jul 2023.

    Can a lawyer tender a document from the bar?
    The law permits lawyers to tender documentary evidence in a specified circumstance. So, although documentary evidence should ordinarily be tendered through a witness, where a public document is relied upon, a copy of the document certified by a public officer may be tendered by a lawyer from the Bar.15 Jun 2023
