An appeal court sitting in Yola has set aside the ruling of a federal high court which voided the candidature of Aisha Dahiru Binani.
The panel of judges directed INEC to forward the name of Sen Aishatu Dahiru Binani to INEC as the Gubernatorial candidate of APC in Adamawa.
The panel also said the request by Malam Nuhu Ribadu for the conduct of fresh exercise amounts to academic exercise hence it was jettisoned.
In October, a federal high court in Yola, nullified the APC primary that produced Binani as the party’s governorship candidate for Adamawa.
The court had ruled that the APC would not have a candidate in the state for the 2023 elections.
Binani, the senator representing Adamawa central, polled 430 votes defeating Jibrilla Bindow, former governor of the state (103 votes) and Nuhu Ribadu, former chairman of the Economic and Financial Crimes Commission (288 votes).
Aggrieved by the result, Ribadu filed a lawsuit to contest Binani’s victory.
Abdulaziz Anka, the presiding judge, nullified the entire primary election. He ruled that the process was not compliant with the 2022 Electoral Act, the Nigerian constitution, and the party guidelines.
The judge said Binani’s victory was in clear contravention of Section 85 of the Electoral Act because there was “manifest overvoting.”
